The increasing prevalence of digital platforms has turned content recommendation algorithms into key actors in shaping users' online experiences. By purposefully guiding users toward specific content, these algorithms can cause material, non-material, and physical harm. The primary issue of this research is to establish the basis of civil liability and identify the responsible party when a user suffers damages resulting from algorithmically recommended harmful content. Using a descriptive-analytical method and drawing upon jurisprudential and legal sources, this article argues that due to the active and editorial role of their algorithms, platforms are no longer "neutral intermediaries" but rather act as the "indirect cause" of the harm. The main hypothesis is that the Fiqh rule of tasbīb (indirect causation), as the stronger cause, provides the most suitable foundation for establishing the civil liability of the platform owner. The findings indicate that the primary responsibility lies with the platform owner, who benefits from and controls this technology. Finally, legislative and executive proposals are presented to clarify the liability of platforms and protect user rights.
